Biography

Caterina Gardiner LLB, LLM, Solr, PhD                                                                                          

Caterina Gardiner specialises in commercial and consumer law.  More recently, her research has focused on e-commerce and the challenges for consumers presented by the growth of online retailing.  She graduated with a LL.B from Trinity College Dublin in 1990 and an LL.M in Commercial Law from University College Dublin in 1996.  She also holds a PhD from University College Cork.  Her PhD thesis explores the tension between private and public regulatory objectives in the regulation of online consumer contracts.  In 2021, she published a monograph entitled "Unfair Contract Terms in the Digital Age: The Challenge of Protecting European Consumers in the Online Marketplace"( Edward Elgar Publishing 2021).  This monograph further develops the themes explored in her doctoral thesis, particularly relating to the effectiveness of the Unfair Contract Terms Directive as a regulatory tool in the context of the digital transformation and accompanying globalisation.

Caterina Gardiner has acted as adviser on several government expert groups including the the Sales Law Review Group, an expert group established by the Minister for Enterprise, Trade and Employment to review sales law in Ireland and provide recommendations for modernisation and reform. She was also an invited member of the first Consumer Rights Advisory Group (2012) that was established to formulate new consumer legislation.  
 
Caterina joined the School of Law in the National University of Ireland, Galway in 1996. She has lectured in many subjects including international trade law, company law, legal and business ethics, business law, commercial law and consumer law.  
 

Research Interests

Caterina Gardiner's main research interests are in the area of sales law, consumer law and electronic transactions.  She has also worked in the field of International sales law and the Vienna Convention on the International Sale of Goods.
 
 July 2012: Invited Member of the Advisory Committee on Consumer Legislation established by the Department of Jobs, Enterprise and Innovation to advise on consumer legislation.
November 2008 - October 2011:  Academic Member of the Sales Law Review Group, an expert group established by the Department of Jobs, Enterprise and Innovation, to review the legislation governing the sale of goods and supply of services. The Group prepared a position paper on the draft Consumer Rights Directive which was published in April 2009.  In October 2011, the Group issued its final report, Report on the Legislation Governing the Sale of Goods and Supply of Services, a comprehensive document containing extensive recommendations for reform of consumer and commercial sales law. 

June, 2006: Appointed Member of the Graz and Salzburg working group ‘Transfer of Movables’ within the Study Group on a European Civil Code and wrote the National Report for Ireland on the Transfer of Movables. This report dealt with issues surrounding the acquisition and loss of movables including the transfer of ownership, the passing of property, agency, the consequences of insolvency of the parties, the nemo dat principle and reservation of title. The Report was published in January 2009.
